Question on SMMA Contractor Acquisition

I've been looking for contractors for the last couple days for my agency, and it will be my first hire. Now, for anyone who is a seasoned agency owner who's hired media buyers and contractors in the past, how do I go about the legalities of the hire? Is having a contract necessary for a contractor? Does it even matter?

Furthermore, if you can, how did you go about your first hire, and what lessons did you learn then, that you follow now?
